USCIS – H1B Cap reached for 2016, Lottery to be held

The news has come out, USCIS has reached the H1B Cap for the year 2016. More than 20000 applications have been received by USCIS under the U.S. advanced degree exemption.

Along with the above, USCIS has also received more than 65000 H1B petitions for general category. As expected, USCIS will use a computer-generated process. This Computer-generated selection process is also known as the lottery

This process helps USCIS to randomly select the petitions needed to meet the caps of 65,000 visas for the general category and 20,000 for the advanced degree exemption.

USCIS will first select 20000 petitions for the advanced degree. All the unselected petitions will be then merged with the general category petitions and then will be put up for the lottery process for the 65000 slots. All the petitions which are received from 1st April till the end of 7th April will be in for the lottery.

For the rejected petitions, USCIS will return filing fees.

The dates for lottery is not yet out. We expect it to be sometime to be around last year time frame of 10th April. Do wait for the updates from us on the lottery dates.
